Terms and Conditions: Rent in 30 Days Guaranteed Special

This document outlines the terms and conditions (“Terms”) governing the “Rent in 30 Days Guaranteed” special (“Guarantee”) offered by Zenith Properties NW, LLC (“Zenith”) to NEW Property Investor Clients (“Owner”) who list a rental unit(s) through Zenith.

By participating in the Guarantee, Owner agrees to the following:

1. Guarantee Summary

Zenith guarantees to secure a qualified tenant for Owner’s single-family rental unit(s) within 30 calendar days, subject to the terms outlined herein. If Zenith is unable to do so, Owner will receive a total of $1,000.00 credited towards the monthly management fee, to be credited each month until the total credit has been fully applied. 

2. Conditions to Qualify for the Guarantee

After an executed Management Agreement is completed, the Guarantee is valid only if all of the following conditions are met:

1. Touring Condition Start Date

The 30-day period begins on the date the rental unit is deemed by Zenith to be in touring condition, defined as:

• The unit is vacant and professionally cleaned.
• All necessary repairs, touch-ups, and safety inspections are completed.
• The property is ready for photography, virtual tours, and physical showings.

Zenith shall determine and confirm in writing the date the property qualifies as being in touring condition.

1. Compliance with Zenith Recommendations

The Owner must strictly follow Zenith’s professional recommendations in the following areas:

• Rental Rate: The listing price must be set at the market rate as advised by Zenith based on current market analysis.
• Pet Policy: The Owner must adopt Zenith’s recommended pet policy, which typically allows for common household pets with reasonable restrictions.
• Market Posting: Zenith will manage and execute the rental listing across recommended platforms. The Owner must approve and not restrict Zenith’s proposed marketing strategy and content.

Failure to comply with any of the above will void the Guarantee.

3. Exclusions and Limitations

The Guarantee does not apply if:

• The Owner restricts showings, declines qualified applicants, or causes delays in application processing.
• Market conditions change drastically due to unforeseen events (e.g., natural disasters, government restrictions).
• The property becomes unavailable for showings due to Owner or third-party interference.
• The unit is removed from the market by the Owner before the 30-day period ends.
• The Owner requests to end the agreement prior to the 1-year term.
• The Owner is a current client of Zenith Properties NW LLC.
• The property(s) are classed as multi-family.

4. Remedy

If Zenith fails to secure a qualified tenant within the 30-day period and all the above conditions have been satisfied, Zenith will provide the Owner with a $1,000 credit towards the monthly management fee, applied each month until credit has fully been depleted. No further financial compensation or liability shall be incurred by Zenith. Owner must still be an active client to receive the full credit.

5. General Provisions

• Amendment: Zenith reserves the right to modify or terminate the Guarantee at any time, with notice to the Owner.
• Interpretation: Zenith shall have sole discretion in interpreting these Terms, including determinations related to compliance and eligibility.
• Governing Law: These Terms are governed by the laws of the State of Washington.
